Privacy Policy
1. The short version
- We build software for licensed daycares and the families they serve. We do not sell personal information and we do not show ads.
- Children do not have accounts. Information about children is entered by adults, and your daycare decides what is collected and who sees it. We process it on the daycare's behalf.
- The App adds phone features to your state's service: push notifications, a front-door kiosk and, as released, camera capture and device sign-in. Device sign-in never sends us your fingerprint or face.
- If a daycare cancels, its data is available to export for 30 days and is deleted within 90 days.
- You can delete your own account from the App or at americadaycare.com/delete-account.
This policy covers the America DayCare mobile app and website, operated by Texas Digital Asset Management Group Inc, doing business as America DayCare and Day Care of Texas (the "Company", "we"). In Texas the App connects to Day Care of Texas, whose own Privacy Policy also applies to that service. Where they overlap, the stricter protection applies.
2. Information we collect about daycare operators
When a daycare signs up for a State Service and uses the App, we collect what is needed to run the account: the operator's name, email address, mobile number, role, daycare or business name, licence or registration number, business address, subscription plan and payment status. Card payments are processed by Stripe; we never see or store full card numbers.
Staff members invited by an operator have a name, email address, role and, if the operator records it, training and background-check dates required by their state.
3. Parent portal accounts
Parents are invited by their daycare. A parent account holds the parent's name, email address and mobile number, the children it is linked to, authorized pick-up persons the parent names, and, if the daycare bills through the service, invoices and payment status. Parents sign in with a one-time code sent to their email and a PIN they choose; we store the PIN only as a one-way hash.
4. Information about children and families
Daycares use the service to keep the records their state requires. Those records can include a child's name, date of birth, enrollment dates, parent and emergency contacts, authorized pick-ups, daily attendance, health checks, allergies and food plans, medications and administration logs, immunization records, incident reports, daily notes, meal counts and, if the daycare or a parent adds them, photographs.
Children do not have accounts and cannot sign in. Our service is not directed to children, and we do not knowingly collect personal information directly from a child under 13. We comply with the Children's Online Privacy Protection Act (COPPA) by acting as a service provider to the daycare, which collects the information from parents and is responsible for any consent its state or COPPA requires. If you believe a child has submitted information directly to us, email support@daycareoftexas.com and we will delete it.
5. Who decides what happens to your family's information
The daycare is the organization that decides what is collected about your family and why, how long it is kept, which staff can see it, and whether to share it with a licensing agency, a doctor or anyone else. We follow the daycare's instructions and the law. If you want to see, correct or delete information about your child, contact your daycare first; we help daycares respond to those requests. Requests about your own parent account can come to us directly (Section 14).
6. Photographs
Daycares and parents may add photos to a child's record, an incident report or a daily note, and, as released, may take them with the App's camera. Photos are stored in the State Service under the daycare's control, are shown only to that daycare's staff and the linked parents, and are never used by us for marketing or to train any system. The daycare's own photo policy and your consent to it govern how photos of your child may be used at the daycare.
7. Job applications
If a daycare uses the service's hiring feature and you apply for a job, your application, résumé and contact details are collected for that daycare, which decides how long to keep them. We do not use applicant information for any other purpose and do not share it with other daycares.
8. How we reach daycares that don't use us yet
To let licensed daycares know about the service, we use the public licensing lists that state agencies publish, such as the Texas Health and Human Services Commission child-care search, which include a daycare's business name, address, licence number and public contact details. We may email, call or mail those daycares. Every message includes a way to opt out, and we honour opt-outs. We do not use this information for any other purpose and do not sell it.
9. Who we share information with
We share personal information only as follows:
- Within your daycare – staff and the parents linked to a child see that child's records as the daycare configures.
- Service providers under contract – cloud hosting (Microsoft Azure); push notifications (Google Firebase Cloud Messaging and Apple Push Notification service); payment processing (Stripe); email delivery (Amazon Web Services and Mailgun); text messages (Twilio); address lookup (Google Maps Platform). They may use information only to provide their service to us and must protect it.
- Legal and safety – when required by law, subpoena or a licensing investigation, or to protect the rights, safety or property of children, families, daycares or the Company.
- Business transfers – if the Company is involved in a merger, acquisition or sale of assets, information may be transferred under this policy.
We do not sell personal information, do not share it with data brokers, and do not share it with advertisers. We do not use third-party advertising or analytics tracking in the App.
10. Text messages, push notifications and email
Text messages. If you give a mobile number and consent, we or your daycare may send texts about your account or your child, such as sign-in codes and pick-up confirmations. Message frequency varies; message and data rates may apply. Reply STOP to cancel and HELP for help. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text-messaging originator opt-in data and consent will not be shared with any third parties.Push notifications. The App registers a push token with Google (Android) or Apple (iOS) so we can deliver alerts such as "Maya arrived". We store the token with your account; the notification text is not kept by Google or Apple after delivery. Turn notifications off in your device settings at any time, and parents can stop arrival and pick-up alerts with the link in any such email.Email. We send service emails to the address on your account. Marketing emails have an unsubscribe link; service and legal notices do not.11. Cookies and device data
The App and website use a sign-in cookie to keep you signed in and a preference setting that remembers your role and state. We do not use advertising cookies or cross-site tracking. When the App runs, we receive the information any app sends: device model, operating-system version, App version, IP address, language and time zone, and error reports if something goes wrong. We use it to make the App work, keep it secure and fix problems. The App does not collect your contacts or microphone, and it never tracks your location in the background. It uses your phone's location only at the moment you sign a child in or out, and only when your daycare needs it for subsidy attendance: Texas requires the signer's location, signature and a live photo for each sign-in and sign-out of a subsidized child. That location, signature and photo are saved with the attendance record, are shown only to the daycare, and are sent to the state's child care subsidy attendance system only if the daycare turns that reporting on. Device sign-in (fingerprint or face unlock) runs entirely on your phone; we receive only a yes or no.
12. How long we keep things
We keep information while an account is active. If a daycare cancels its subscription, its data is available to export for 30 days, and we delete it within 90 days of cancellation, except where the law requires us to keep something longer or where it is needed to resolve a dispute. Backup copies expire on a rolling schedule after that. Parent accounts that a daycare removes are deleted on the same schedule. Daycares are responsible for keeping records their state requires for the periods it requires, so export before closing an account.
13. Security
Information is encrypted in transit (TLS) and at rest on our cloud storage. Access is limited by role and by least privilege, administrative access requires two-factor authentication, and access is logged. The push gateway, databases and keys are reachable only from inside our systems, and we rotate credentials on a schedule. Sign-in uses one-time codes and PINs stored as one-way hashes. No method of transmission or storage is completely secure; report any concern to info@tdamg.com.
14. Your rights
You can ask us to confirm whether we process your personal information, to access it, to correct it, to delete it, to receive a portable copy, and to opt out of targeted advertising, sale or profiling, none of which we do. Texas residents have these rights under the Texas Data Privacy and Security Act; residents of California and other states have similar rights under their laws, and residents of the European Union or United Kingdom have rights under the GDPR and UK GDPR where those apply.
To make a request, use the App's account settings, visit americadaycare.com/delete-account, or email support@daycareoftexas.com. We will verify the request and respond within 45 days; if more time is genuinely needed we may take up to 45 more and will tell you. If we cannot act on a request, we will explain why, and you may appeal; we answer appeals within 60 days. Texas residents may also raise a concern with the Texas Attorney General.
If your request concerns a child enrolled at a daycare, contact that daycare; they hold the decision, and we assist them.
15. Changes to this policy
We may update this policy. If a change materially affects how we handle your information, we will tell you by email or in the App before it takes effect. The date at the top shows when it was last revised.
Artificial intelligence (AI) service provider
Some optional features, such as help drafting replies to enrollment enquiries, use an AI service provided by Anthropic, PBC (the Claude API). When a daycare turns on this feature, the content of the enquiry is sent to Anthropic only to generate a suggested reply. Anthropic processes this data on our behalf under its commercial terms, which do not allow it to use our data to train its models, and it does not sell it. Daycares can turn this feature off at any time. We do not use AI to make decisions about children or families.
